This Website is intended to provide information about Packard Tavern, a restaurant operated by High Tide Hospitality, for users in the United States. You agree to use this Website only for lawful purposes and in a way that does not infringe on the rights of others.

2. Accuracy of Information

While we strive to keep information about our menu, pricing, hours, and availability accurate and up to date, typographical errors or omissions may occur. Content on this Website is for informational purposes only and does not constitute a binding offer or contract.

All content on this Website — including text, graphics, logos, photos, and layout — is the property of High Tide Hospitality or its licensors and is protected by United States copyright laws. You may not copy, reproduce, or distribute any content from this Website without prior written permission. You acknowledge that the trademarks used and displayed on the Website are and shall remain the sole property of High Tide Hospitality or the trademark owner.

4. Third-Party Links & Tools

Our Website is built on SquareSpace. It may contain links to external third-party services, including reservation platforms, online ordering, and delivery partners. We do not control and are not responsible for the content, privacy policies, or practices, or lack thereof, of any third-party websites or services. If you decide to access any of the third-party services linked to the Website, you do so entirely at your own risk. You acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by, or in connection with, any third-party services or websites.

5. Gift Cards

Gift cards purchased through Packard Tavern or any other High Tide Hospitality concept may be redeemed at any High Tide Hospitality restaurant location, excluding The Waterman Fish Bar at the Charlotte Douglas Airport. Gift cards do not expire and no fees will be deducted from the balance. Gift cards are not redeemable for cash except where required by law, cannot be replaced if lost or stolen without proof of purchase, and are not for resale.

6. Loyalty Program

6.1 Eligibility & Enrollment

Our loyalty program, High Tide Loyalty, (the “Program”) is available to guests who enroll using a valid email address or phone number. Enrollment is free and no purchase is required to sign up. By enrolling, you agree to this Section 6 and any applicable privacy disclosures in our Privacy Policy.

6.2 How Points Are Earned

Members earn points based on eligible purchases made at Packard Tavern. Earn rate: 1 point per $1 spent on eligible purchases. Points are earned on net sales, excluding taxes, tips, service charges, gift card purchases, delivery fees, and other excluded items, as applicable. Points may not be earned on voided or refunded items, and may be reversed if a refund is processed.

6.3 How Rewards Are Redeemed

Rewards become available once a member reaches the required point threshold(s). Reward(s): 100 points = $10 OFF, 200 points = $20 OFF, etc. Rewards have no cash value and may not be exchanged for cash. Rewards may be subject to restrictions, such as exclusion of alcohol where prohibited by law or exclusion from already-discounted items.

6.4 Points & Reward Expiration

Points expiration: none. Reward expiration: none, except for automated birthday rewards, which are valid only for the duration of your birth month. Birthdate must be provided to receive these rewards. We may remove points or rewards from accounts that are inactive or closed, consistent with these Terms and Conditions and applicable law.

6.5 Account Lookup & Communications

Members may be able to access account status (points, rewards) via a lookup page or messages sent after enrollment. By enrolling, you may receive Program-related communications — such as welcome messages, balance updates, or reward notifications — via email or SMS, depending on how you enroll and your communication settings.

6.6 Linked Payment Cards

A payment card used during checkout may be linked to a member account when the member is identified during the transaction. Members may be able to manage linked cards through their loyalty account page.

6.7 Adjustments, Errors, and Disputes

If points or rewards appear incorrect, contact us at support@eat704.com within 14 days of the visit. We may request receipt details, such as the date, time, and last four digits of the card used, to investigate.

6.8 Abuse, Fraud, and Account Closure

We may suspend or terminate accounts, and remove associated points or rewards, if we suspect fraud, abuse, or violations of these Terms and Conditions. Accounts are non-transferable and intended for individual guest use.

6.9 Changes to the Program

We may modify or end the Program at any time, to the extent allowed by law. Updates will be posted on this page with a revised Effective Date.

6.10 SMS Terms

We will not share your phone number with anyone for marketing purposes. If you agree to receive SMS messages, standard messaging rates may apply and may vary by phone carrier. You will likely receive no more than [0-3] SMS messages daily, but message frequency may change. You may opt-in to receive SMS messages from us by [submitting a form online]. Reply HELP for help or STOP to opt-out. Once you opt-out, you will not receive any more messages.

7. Age Requirements & Right to Refuse Service

Our Website is not directed to individuals under the age of 13. Some menu items may contain alcohol and are intended for guests 21 years of age or older. We reserve the right to request valid identification and to refuse service to anyone, at our discretion, in accordance with applicable law.

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT WILL HIGH TIDE HOSPITALITY, PACKARD TAVERN, AND/ THEIR RESPECTIVE AFFILIATES AND/OR RELATED ENTITIES, AND EACH OF THEIR RESPECTIVE MEMBERS, MANAGERS, OWNERS, OFFICERS, DIRECTORS, PARTNERS, EMPLOYEES, AGENTS, CONSULTANTS, CONTRACTORS, ADVISORS, INSURERS, ATTORNEYS, VOLUNTEERS, REPRESENTATIVES, AND EACH OF THEIR RESPECTIVE SUCCESSORS AND ASSIGNS (COLLECTIVELY, “RELEASEES”) BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE WEBSITE, ANY OTHER COMPANY CONTENT, ANY THIRD-PARTY WEBSITES LINKED TO THE WEBSITE, ANY CONTENT ON SUCH THIRD-PARTY WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.

IN NO EVENT SHALL THE RELEASEES BE LIABLE FOR ANY CLAIMS OF INJURY, DEMANDS, LIABILITIES, DAMAGES, LOSSES, SUITS, DEMANDS, CAUSES OF ACTION (INCLUDING, WITHOUT LIMITATION, NEGLIGENCE) OR OTHER CLAIMS OF ANY NATURE WHATSOEVER, INCLUDING, WITHOUT LIMITATION, ANY LOSSES FOR PROPERTY DAMAGE, PERSONAL INJURY, OR DEATH, IN EXCESS OF THE AMOUNTS YOU PAID TO THE COMPANY IN THE TWELVE (12) MONTH PERIOD IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO ANY OF THE FOREGOING, WHETHER ONE TIME OR IN THE AGGREGATE.

IF YOU ARE A CALIFORNIA RESIDENT, YOU WAIVE CALIFORNIA CIVIL CODE SECTION 1542, WHICH SAYS: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH, IF KNOWN BY HIM MUST HAVE MATERIALLY AFFECTED HIS SETTLEMENT WITH THE DEBTOR.”

The limitations of liability set out above do not apply to liability resulting from our gross negligence or willful misconduct.

THE FOREGOING DOES NOT AFFECT ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

10. Indemnification

You agree to defend, indemnify, and hold harmless the Releasees from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to your violation of these Terms and Conditions or your use of the Website. You agree to cooperate as fully as reasonably required in the defense of any such claim. We reserve the right to assume exclusive defense of any matter subject to indemnification by you, and you shall not settle any such matter without our prior written consent.

11. Governing Law; Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law principles. Any legal suit, action, or proceeding arising out of, or related to, these Terms and Conditions or the Website shall be instituted solely and exclusively in the federal or state courts having jurisdiction in Mecklenburg County, North Carolina.

12. Limitation on Time to File Claims

ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THESE TERMS AND CONDITIONS OR OUR COMPANY CONTENT MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES; OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.

If any provision of these Terms and Conditions is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms and Conditions will continue in full force and effect.

The Terms and Conditions, Accessibility Statement, and Privacy Policy constitute the sole and entire agreement between you and us regarding the Website and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Website.
